2. The petitioners seek bail in connection with Aurangabad Town P.S. Case No. 297 of 2024, instituted for the offences punishable under Sections 302, 120-B and 34 of the Indian Penal Code.
3. The prosecution case, in short, is that, the petitioners along with other family members with a common intention strangulated the daughter of the informant.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the
Patna High Court CR. MISC. No.36869 of 2025(2) dt.18-06-2025 2/3 present case. Charge-sheet has been submitted in this case. Learned counsel for the petitioners also submits that the petitioners are Gotni and Dewar of the deceased. Postmortem report of the deceased shows cause of death is asphyxia due to hanging, resulting into C.R. failure. It is next submitted that the deceased has committed suicide due to some quarrel in between husband and wife. The petitioners are separate in mess and business from the husband of the deceased. The petitioners are in custody since 13.01.2025 and have got no criminal antecedent.. Learned counsel for the petitioners further submits that similarly situated co-accused have been granted regular bail by a Co-ordinate Bench of this Court vide order dated 17.01.2025 passed in Cr. Misc. No. 88950 of 2024.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.
7. Let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Court
