JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-07-2016 Heard learned counsels for the petitioners and the State. The petitioners being the parents of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 498A, 406 and 307/34 of the Indian Penal Code.

The prosecution case is that the informant was married with the son of the petitioners, Ravi Nandan Pandey on 06.06.2014 but after one month of the marriage, the husband of the informant and other family members including the petitioners started inflicting torture and made assault for non-fulfillment of further dowry demand. It is also alleged that on 05.04.2015, all the accused persons tied the informant with pillar putting rope around

Patna High Court Cr.Misc. No.24011 of 2016 (4) dt.01-07-2016 2/2 the neck when petitioner no.2 being the mother-in-law assaulted the informant with hot iron rod and husband of the informant poured kerosene oil.

It is submitted by learned counsel for the petitioners that after one year of marriage, the accusation has been levelled and for the specific incident of 05.04.2015, the complaint was filed on 17.02.2016 which came to be registered as a police case after being transferred under Section 156(3) Cr. P.C. on 03.04.2016. Actually no injury was caused to the informant. The informant herself disowned the house of her in-laws on 05.04.2015. The thrust of accusation is against the husband of the informant and petitioners are aged persons.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran at Motihari in connection with Chhatauni P.S.
