Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.

The prosecution case is that the petitioner and others committed theft of mobile phone and Rs. 6,000/- cash from the house of the informant.

It is submitted by the learned counsel for the petitioner that for the occurrence of 09.03.2016 the First Information Report was registered on 11.03.2016 and only on suspicion accusation has been levelled. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

The aforesaid facts constitute ground

Patna High Court Cr.Misc. No.23086 of 2016 (2) dt.23-05-2016 for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kahalgaon P.S. Case No. 75 of 2016, pending in the court of learned Chief Judicial Magistrate, Bhagalapur.

With the above observation this application is disposed of.
