The petitioners, namely, Sujit Yadav, Ranjit Yadav and Manish Yadav are apprehending their arrest in a case under Section 307 and others sections of the Indian Penal Code and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
The informant alleged that while his sons were sitting at her Darwaza, the accused persons came and assaulted them. The petitioners are also alleged to have abused the sons of the informant by naming their caste.
It is submitted that the present case was lodged on 02.09.2014 but from the side of the petitioners, on the same day,
Patna High Court Cr.Misc. No.1947 of 2015 (2) dt.19-01-2015 2/2 Laukariya P.S. Case No. 90/2014 was lodged. This is the counter blast of the case lodged on behalf of the petitioners. It is further submitted that the offence under Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act is not attracted as the occurrence is said to have taken place inside the house, which is not a public place. The injuries are simple in nature.
Considering the facts aforesaid, let the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, be released on anticipatory bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bagaha, West Champaran in Laukariya P.S. Case No. 91/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
