JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code.

As per the prosecution case, this petitioner after taking wine entered into room of the informant and started scuffling with his wife and when informant came to save petitioner assaulted him with Dab causing injury on his head. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case due to village politics. The injury has been found to be simple in nature and as a matter of fact petitioner and informant are co-villager and on call of the wife of informant petitioner

Patna High Court CR. MISC. No.48566 of 2021(2) dt.23-11-2021 2/2 into his house and on suspicion of illicit relation the informant started scuffling with this petitioner as a result of which he got injured. Petitioner claims clean antecedent and is in custody since 26.01.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Dhaka, Sikrahna, East Champaran, Motihari in connection with Kundwa Chainpur PS case No.36/2020.
