This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 18.01.2024 passed in Cr. Misc. No. 73973 of 2023.

2. The petitioner seeks regular bail in connection with Silao P.S. Case No. 38 of 2023 registered for the offence under Sections 498(A) and 304(B) of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have tortured and killed his wife for demand of dowry

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 13.03.2023 and in the trial, some witnesses have been examined.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case as well as the period of custody, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Nalanda/concerned Court below in connection with Silao P.S. Case No. 38 of 2023 subject to condition that:- (i) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and noncooperation in the trial shall result in cancellation of the bail bonds of the petitioner.
