The appeal has been filed against the order dated 9.8.2011 passed by the Income-tax Appellate Tribunal, Patna Bench, Patna in ITA No. 149/PAT/2009 relating to assessment year 2003-04.

In view of the order passed today in M.A.No. 916 of 2011 relating to the same assessee for the assessment year 200203 against the common order passed by the ITAT, Patna Bench, Patna, this appeal is also dismissed for the same reasons. (Ramesh Kumar Datta, J) (Anjana Mishra, J) spal/- U
