Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Gwalpara P.S. Case No.50 of 2022 registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act. Allegedly, from the possession of this petitioner a loaded country-made gun as well as two used cartridges and a motorcycle were recovered and one co-accused namely Butan Sharma was also apprehended along with the petitioner. The main submissions advanced by the learned counsel Mr. Neeraj Kumar Alias Sanidh for the petitioner are

Patna High Court CR. MISC. No.40310 of 2022(2) dt.12-10-2022 2/2 that the petitioner has been languishing in jail since 15th March, 2022 and co-accused Butan Sharma has been granted bail by learned Court below vide Annexure-2 and against the petitioner the investigation has been completed.

Learned APP Mr. Dilip Kumar No. 1 appearing for the State has opposed the bail prayer.

In view of the above submissions and mainly considering the petitioner's custody period and his clean antecedent and also the fact that the investigation against the petitioner has been completed and his case appears to be at the initial stage, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Gwalpara P.S. Case No.50 of 2022.
