The petitioner seeks bail in Dariyapur P.S. Case No. 212 of 2017 instituted for the offence under Section(s) 304B, 201 and 34 of Indian Penal Code.

In the written report the informant has levelled allegation against husband and his other family members of committing torture with daughter of the informant after marriage for non-fulfillment of demand of dowry and committing murder of his daughter and 1 1⁄2 year old grand daughter.

Counsel for the petitioner submits that petitioner is not named in the written report. The name of petitioner has transpired during investigation after one year on the basis of

Patna High Court CR. MISC. No.37030 of 2019(2) dt.20-06-2019 2/2 statement recorded in paragraph-42 of the case diary where in it has been stated that Mobile of daughter of the informant was found active and she was found in touch with this petitioner. He further submits that petitioner is not named in the written report. Petitioner is in custody since 27.2.2019 having clean antecedent.

Counsel for the informant has appeared and opposed the prayer for bail.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Chapra, in connection with Dariyapur P.S. Case No. 212 of 2017, subject to the condition that both the bailors will be close relatives of the petitioner.
