Mr. Akbar Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 17-12-2021 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek bail in connection with Gopalganj Town P. S. Case No.497 of 2021, instituted for the offences under Sections 30(a)/ 41(i) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioners submits that the petitioners are in custody since 15.07.2021, they are persons with clean antecedents and charge-sheet has been submitted in this case.

Allegation is of recovery of 36 litre of liquor from

Patna High Court CR. MISC. No.48381 of 2021(2) dt.17-12-2021 2/2 asbestos house of petitioners and petitioner no.1 disclosed that he brings liquor and his son petitioner no.2 sells the same. The learned counsel for the petitioners submits that petitioners have been falsely implicated and the alleged asbestos house of the petitioners is much far away from their own house and as such, were not aware, who had kept the said liquor there. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioners are in custody since 15.07.2021, they are persons with clean antecedents and charge-sheet has been submitted in this case, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IInd-cumSpecial Judge, Excise, Gopalganj in connection with Gopalganj Town P. S. Case No.497 of 2021.

The application stands allowed.
