JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 323, 506/34 and other sections of Indian Penal Code and Section 56 of Bihar Mines Amendment Act.
As per FIR, this petitioner tried to bribe the officials while truck in question was being inspected by the Police. Petitioner is son of the owner of the truck.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that truck in question was loaded with sand and has a valid challan copy of which is annexed as Annexure-2. As such, there was no occasion to give bribe to the officials.
Petitioner has got clean

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Town (Hajipur) P. S. Case No. 863 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) navya/- U T
