The petitioner seeks bail in a case registered under Sections 341, 323, 447, 307, 504/34 of the Indian Penal Code. Allegation is that the petitioner fired from his gun upon the informant and Sumitra Devi and Abhinti Devi, due to which they sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 7.1.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. As per the F.I.R., the petitioner is said to have fired upon the informant and Sumitra Devi and Abhinti Devi. The injury report is Annexure 2 to the present application. The injuries are superficial in nature caused

Patna High Court CR. MISC. No.39717 of 2019(2) dt.28-06-2019 2/2 by hard and blunt substance. Injury report of the victim does not corroborate with the allegations made in the F.I.R. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Shakurabad P.S. case No.9 of 2018.
