JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code and u/s 25(1-B)a, 26/27/ 35 of Arms Act.
As per the prosecution case, on 13.10.2019 during the course of vehicle checking three miscreants riding on a Pulsar motor cycle tried to escape and on chase they fired at the police party. Two of the miscreants managed to flee away while this petitioner was apprehended. On search, one country made loaded pistol and one motor cycle without any number plate were recovered from the possession of this petitioner. Learned counsel appearing for the petitioner submits
Patna High Court CR. MISC. No.48567 of 2021(2) dt.23-11-2021 2/2 that petitioner is innocent and has falsely been implicated in the case. It is submitted that alleged motor cycle was purchased on loan financed by Sri Ram Commercial Vehicle Finance and the same was not stolen one. Petitioner is in custody since 13.10.2019 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub divisional Judicial Magistrate, (West) Muzaffarpur in connection with Kanti PS case No.769/2019.
