NATH ORAL ORDER 04-07-2016 Heard the learned counsel for the petitioner. By the impugned order the learned court below has recorded the finding dismissing the suit in default. The learned counsel for the petitioner has submitted that the learned court below has exercised its inherent power but the correct procedure has not been followed in recalling the order. After considering the submissions and perusal of the impugned order, it appears that the learned court below has passed the order on the ground that after accepting the submission made by the learned counsel for the plaintiff that the next date according to his diary was 14.08.2013 and not 08.07.2013 when the suit was dismissed. The learned court below has accepted the said contention and prayer and accordingly passed the order. This Court does not find any error of jurisdiction or material irregularity in passing the impugned order.
The revision application is, accordingly, dismissed.
