JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-09-2021 As prayed for, let the learned counsel appearing for the petitioners remove the defect(s), as pointed out by the office vide its notes dated 24.08.2021, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel appearing on behalf of petitioners and learned A.P.P. appearing for the State through video conferencing.

This application is filed for modification of order dated 26.03.2021 passed in Criminal Miscellaneous No. 34604 of 2020.

Patna High Court CR. MISC. No.49025 of 2021(2) dt.15-09-2021 2/2 Learned counsel appearing on behalf of the petitioners submits that petitioners have been granted pre-arrest bail on 26.03.2021 passed in Criminal Miscellaneous No. 34604 of 2020 with a direction to surrender before the court below within a period of four weeks on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II-cum-Special Judge, Excise, Siwan, in connection with Basantpur P.S. Case No. 110 of 2020, but, due to some unavoidable circumstances, petitioners could not surrender before the Court below within the stipulated time. In such view of the matter, let the time to surrender of the petitioners, as ordered on 26.03.2021 passed in Criminal Miscellaneous No. 34604 of 2020, be further extended by four weeks from today.

Accordingly, the modification application is allowed and the order dated 26.03.2021 passed in Criminal Miscellaneous No. 34604 of 2020 is modified to the above extent.

This application stands disposed of.
