JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-07-2016 Heard the learned counsel for the petitioner and the learned A.P.P. representing the State.

The petitioner seeks bail in connection with Haspura P.S. Case No. 115 of 2015 registered for the offence punishable under Section 392 of the Indian Penal Code.

The petitioner and some other co-accused were apprehended with country made pistol and stolen motor-cycle for which Haspura P.S. Case No. 116 of 2015 was registered and they confessed their guilt regarding their involvement in the present case.

Submission is of false implication and that there is no legal and tangible material against the petitioner in this case, co-accused Guddu Kumar @ Rohit and others have already

Patna High Court Cr.Misc. No.21941 of 2016 (3) dt.15-07-2016 2/2 been allowed bail, the petitioner is suffering in custody since 14.01.2016, he has not been put on T.I.P. and nothing regarding this case has been recovered from his possession. Learned A.P.P. fairly submits that other co-accused have been allowed bail but the petitioner has got criminal antecedent.

In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Haspura P.S. Case No. 115 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
