Versus
The State of Bihar .... .... Opposite Party ====================================================== Appearance :
For the Petitioner/s : Mrs. Pushpa Sinha For the Opposite Party/s : Mr. Sanjay Kumar Singh (App) ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 2.
13-03-2015 The sole petitioner, apprehending her arrest in Bariarpur P.S. Case No. 77 of 2014 registered for the offence under Sections 467, 468, 471 & 120B of the Indian Penal Code, has prayed for grant of anticipatory bail.
Learned counsel for the petitioner submits that at the time of appointment, the petitioner had not submitted any forged certificate, however; falsely a case has been instituted against the petitioner on an allegation that she has produced forged certificate to show that she has passed Matriculation Examination in 1st Division.
Learned Addl. Public Prosecutor has opposed the prayer of bail.
F.I.R. was lodged against the sole petitioner on allegation that she obtained employment as Anganbari Sewika on
Patna High Court Cr.Misc. No.40178 of 2014 (2) dt.13-03-2015 2/2 the basis of forged certificate.
Keeping in view the fact that the petitioner is sole accused in the F.I.R. and there is accusation against the petitioner, I do not find any ground to extend the privilege of anticipatory bail to the petitioner.
The petition stands dismissed.
