Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State in virtual Court proceeding.
Petitioner seeks bail in a case registered in connection with Konch P. S Case No. 39 of 2021 for the offences punishable under Section 420, 313, 304/34 of the Indian Penal Code .
Learned counsel for the petitioner submits that petitioner has clean antecedent and has been falsely implicated in this case. Petitioner is not a doctor and he has no concerned with the said occurrence. He is only brother of co-accused Doctor Shivam Kumar. He further submits that wife of the
Patna High Court CR. MISC. No.47902 of 2021(3) dt.18-01-2022 2/2 informant was not pregnant at the time of D.N.C. Learned counsel for the State vehemently opposed the bail prayer of the petitioner and submits that there is sufficient material against the petitioner. Petitioner and coaccused is involved in the present matter due to the fact that wife of the informant has died.
Accordingly, I am not inclined to grant privilege of bail to the petitioner and hence, his prayer for bail in connection with Konch P.S.Case No. 39 of 2021, pending in the court of learned Judicial Magistrate 1st class, Gaya stands rejected. (Rajesh Kumar Verma, J) N.K/- U T
