The petitioner apprehends his arrest in connection with Atri P.S. Case No.46 of 2022, registered for the offences punishable under Sections 341, 323, 353, 504 and 506 of the Indian Penal Code.

The prosecution case, in brief, is that on 14.02.2022 at about 10.00 A.M., the informant was receiving form from the beneficiaries of Pradhan Mantri Awas Yojana in presence of local Mukhiya and at about 2.00 P.M., the petitioner came there and caught the collar of the informant and started abusing him. It is also alleged that the petitioner threw the forms related to Pradhan Mantri Awas Yojana and threatened to kill the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.39211 of 2022(2) dt.17-11-2022 2/2 present case. It is submitted that the petitioner has got one criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the petitioner is made accused in the present case as he raised objection with regard to the list of beneficiaries prepared by the Mukhiya and the informant.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the fact that no specific overt act is alleged against the petitioner, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIII, Gaya in connection with Atri P.S. Case No.46 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
