JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 21-02-2017 Though the writ application was initially filed for directing the respondents to pay retiral benefits of the petitioner i.e. Pension, Gratuity, G.P.F. and Commutation of Pension, it is admitted by the learned counsel for the petitioner that during pendency of the writ application, the amount of pension and final gratuity of the petitioner has been paid, but the amount of G.P.F. has not been paid till date. He submitted that the writ application may be disposed of by giving liberty to the petitioner to make representation before the authorities in case of any error in calculation of the amount already paid to him and directing the respondents to pay the amount of G.P.F. without any further delay.

On the other hand, learned counsel for the State submitted that the grievance of the petitioner in respect of nonpayment of G.P.F. amount would be redressed within two weeks, as the statement of the contributions made by the petitioner has already been obtained.

Considering the submission made on behalf of the petitioner and the fair stand taken by the learned counsel for the State, the writ application is disposed of with a direction to the respondents to make payment of the G.P.F. amount to the petitioner within a fortnight from today. It is further directed that in case the petitioner raises any grievance by filing representation in respect of calculation of pension amount already paid to him, the Block Development Officer, Kako, Jehanabad shall consider and dispose of the same by passing a reasoned order within eight weeks from the date of receipt of such representation. In case any further amount is found to be admissible to the petitioner, the same should also be sanctioned for payment within the aforementioned period.
