The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 504, 120B, 506/34 of the Indian Penal Code. The prosecution case is that the petitioner used to keep two trucks for commercial purposes. The petitioner took loan of Rs.1,00,000/-from the informant for repairing of truck and assured the informant that he will execute the sale deed with regard to a land in case of non return of the loan amount with regard to khata no. 429, plot no. 548, area 06 decimals within a period of six months, but neither sale deed was executed nor the money was returned rather sale deed with regard to the said land was executed in favour of some other person. It is submitted by the learned counsel for the petitioner that there is no proof with regard to payment.
Patna High Court Cr.Misc. No.22750 of 2016 (2) dt.20-05-2016 Basically it is a case of civil nature of dispute. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the nature of accusation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 369 of 2014, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
