1. Heard learned counsel for the petitioner and learned A.P.P. for the State along with learned counsel for the O.P. No.2.
2. The petitioner apprehends his arrest in connection with Complaint Case No.1300/2018 registered for the offence punishable under Sections 498A and 323 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the case was referred for mediation and in the mediation proceeding the dispute in between the petitioner and the O.P. No.2 stands resolved. It is also submitted that the petitioner will seek custody of the child in accordance with law. It is next submitted that one time settlement in between the petitioner and the O.P.
Patna High Court CR. MISC. No.39198 of 2023(4) dt.21-02-2024 2/2 No.2 was arrived at Rs.3,10,000/-, out of which Rs.1,50,000/- has already been paid to the O.P. No.2 and the rest amount of Rs.1,60,000/- is being paid by a Demand Draft bearing No.012236 dated 14.02.2024, drawn in favour of Mnjera Khatoon. The said Demand Draft has been handed over to the learned counsel for the O.P. No.2, who accepted the same so that the same be handed over to the O.P. No.2.

Considering the submissions made by the learned counsels for the parties, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.2000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Katihar in connection with Complaint Case No.1300/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
