JUSTICE MUNGESHWAR SAHOO ORAL ORDER 15-09-2017 The learned counsel, Mr. Kaushal Kumar Singh, appearing on behalf of the plaintiff-respondent No.1 submitted that this writ application has become infructuous because Title Appeal No.2 of 2012 has already been decided by the lower appellate Court on 06.09.2017.
The learned counsel, Mr. Prabhat Kumar, appearing on behalf of the petitioner submitted that he has got no instruction about the disposal of Title Appeal.
However, in view of the categorical submission made by learned counsel for the plaintiff-respondent that the Title Appeal has already been disposed of, this writ application has dismissed as infructuous. If the Title Appeal has not been disposed of, the petitioner is at liberty to file a slip before this Court on Monday mentioning the same fact.
