2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 272 and 273 of IPC and Section 30 (a) of Bihar Prohibition and Excise Act .
3. It is alleged that three liters of illicit liquor has been recovered from the motorcycle of the petitioner.
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . It was co-accused Suman Thakur who was the driver of the motorcycle of petitioner, carrying illegal liquor with him without knowledge and consent of this petitioner. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the
Patna High Court CR. MISC. No.45000 of 2024(2) dt.25-07-2024 2/2 aforesaid recovery. Petitioner is lady and claims clean antecedent.
5. Learned counsel for the State opposes the bail petition.
6. Considering the quantity, petitioner is lady claims clean antecedent and other circumstances of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge cum Special Judge Excise Act Madhubani in connection with Basopatti Police Station Case No. 15 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
