ANJANA MISHRA ORAL ORDER 02-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Rajiv Nagar P.S. Case No.389/15 for the offences under Sections 406, 420, 467, 468 of the I.P.C. and 3 of the Public Property Damage Act.

Learned counsel for the petitioner submits that the present case has been instituted by the Executive Engineer, Bihar State Awas Board, with oblique motive to extract illegal gratification, alleging that illegal construction works of the petitioner were going on by encroaching the land of Bihar State Awas Board. But it is submitted that there is no encroachment whatsoever on the land of Bihar State Awas Board.
