The petitioner apprehends his arrest in Falka P.S. Case No. 33/2016, registered for the offences punishable under Sections 379, 363 and 366 of the Indian Penal Code.
The informant alleged that his wife was talking with petitioner in his absence. It is alleged that petitioner kidnapped his wife.
Learned counsel for the petitioner submitted that the wife of the informant aged about 35 years and she left the house of her husband and went to her Naihar. The informant brought his wife after twenty days of the occurrence. The informant in his further statement disclosed that his wife informed him that she gave Rs. 40,000/- to the petitioner for some work. It is further
Patna High Court Cr.Misc. No.23820 of 2016 (3) dt.04-08-2016 2/2 submitted that after three months of the occurrence the victim altogether came with different story of her kidnapping. She disclosed that the petitioner gave him medicine and after taking that medicine she became unconscious and petitioner took her to Punjab.
It appears that victim is a major woman.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in connection with Falka P.S. Case No. 33/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
