JUSTICE SATYAVRAT VERMA ORAL ORDER 02-02-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Complaint Case No.13(c)/ 2020 arising out of DRI Patna Unit Case No.20/2019-20, instituted for the offences under Sections 135(1)(a) and 135(1)(b) of the Custom Act, 1962. The learned counsel for the petitioner submits that the petitioner is in custody since 27.02.2020, he is a person with clean antecedent and charge-sheet has been submitted in the case.
It is further submitted by the learned counsel for the petitioner that the co-accused Chandan Kumar @ Chandan
Patna High Court CR. MISC. No.49414 of 2021(3) dt.02-02-2022 2/2 Mukhiya has been granted bail by order dated 23.06.2021 in Cr. Misc. No.8217 of 2021. The learned counsel submits that coaccused Chandan Kumar was alleged to have provided the fake currency to the petitioner.
At this stage, the learned counsel for the petitioner seeks permission to withdraw the present bail application with a liberty to the petitioner to renew his prayer for bail after framing of charge as it has been submitted by the learned counsel for the petitioner that charge till date has not been framed. Permission is accorded.
Accordingly, instant petition is dismissed as withdrawn with the liberty aforesaid.
