The petitioner is apprehending his arrest in a case registered under Section 47(a) of the Excise Act. The excise officials raided the house of Birju Rai and recovered 70 litres of country-made liquor and other materials. The petitioner was not apprehended on the spot. It is submitted that Birju Rai disclosed that he is labourer of Mantu Tiwari, the petitioner, and works on daily wages on payment of Rs. 500/- per day.
It appears from perusal of the seizure list that the house of accused no. 1, Birju Rai was raided from where countrymade liquor and other materials were recovered. Except the confession of co-accused, from whose house country-made liquor
Patna High Court Cr.Misc. No.2962 of 2015 (2) dt.21-01-2015 2/2 and other materials were recovered, nothing has been recovered from the possession of the petitioner.
Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K. Bharti, Judicial Magistrate 1st Class, Motihari, East Champaran in Excise Case No. 12 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
