2. Petitioner seeks bail who is in custody since 09.01.2025 in connection with Amour P.S. Case No. 93 of 2023, F.I.R. dated 15.03.2023 for the offences punishable under Sections 147, 341, 323, 379, 302 of the IPC.

3. According to prosecution case, the petitioner is said to have assaulted the informant's wife with khanti and injured her badly and she died during the treatment. It is further alleged that other accused persons have assaulted the informant and his daughter and some co-accused persons have snatched 8 bhar silver necklace and Rs. 25,000/- cash.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the

Patna High Court CR. MISC. No.42575 of 2025(3) dt.01-08-2025 2/2 F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R. He further submits that it appears from the FIR itself that due to some admitted land dispute, the present occurrence has taken place and as per allegation in the FIR, the petitioner has assaulted the wife of the informant with an iron rod and she died during the treatment. It is further submitted that the petitioner had no intention to kill the informant's wife, on the spur of the moment, the present occurrence has taken place. The petitioner is in custody since 09.01.2025.

5. The learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner and submits that it appears from the FIR that there is direct and specific allegation against the petitioner supported by the medical evidence (postmortem report).

6. Considering the aforesaid facts, there is direct and specific allegation assault against the petitioner supported by medical evidence, I am not inclined to enlarge the petitioner on bail in connection Amour P.S. Case No. 93 of 2023 pending in the court of learned C.J.M., Purnia.

7. Prayer is refused.
