2. The petitioners seek regular bail in connection with Muffasil P.S. Case No. 381 of 2024 lodged on 02.11.2024 under Sections 103(1), 61(2) and 351(2) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution, F.I.R. has been lodged against five named accused persons, alleging that the deceased husband of the informant was working at the house of the petitioners, and an allegation has been made that poison was administered, due to which the informant's husband died.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. He further submits that Petitioner No. 1 has been in custody since 06.11.2024 and Petitioner No. 2 has been in custody since 09.01.2025. He submits that the dead body of the deceased was not recovered from the petitioners' house, but rather from another location. He submits that the allegation of assault is against other accused persons and not against the petitioners.

Counsel further submits that both the petitioners and the informant are residents of the same village and are well known to each other, and the present case has been lodged against the petitioners only with an ulterior motive. He also submits that there is no material against the present petitioners save and except that, during investigation, their names came up through the informant merely on the basis of suspicion. He also submits that, as stated in paragraph No. 3 of the bail application, the antecedents of the petitioners are not clean, as one criminal case is pending against the petitioner No. 1 and two criminal cases are pending against the petitioner No. 2.
6. Learned APP for the State opposes the prayer for bail but fairly submits that it is true that the dead body has not been recovered from the petitioner's house.

In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail, on being satisfied by the trial court that the petitioners are not absconding in any of the cases which are pending against him whose details are mentioned below, as well as on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of Chief Judicial Magistrate, Begusarai, in connection with Muffasil P.S. Case No. 381 of 2024, subject to the following conditions as laid down under Section 480(3) of the BNSS.
