JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406,409,467,468 and 471/34 of the Indian Penal Code.
It is alleged that the petitioner took loan of rupees twenty one lacs from the Syndicate Bank on the basis of fraudulent documents.
Learned counsel for the petitioner submits that the petitioner undertakes to deposit the loan amount along with interest.
Considering the stand of the petitioner, let the above named petitioner be released on provisional anticipatory bail for a
Patna High Court Cr.Misc. No.4079 of 2015 (2) dt.30-01-2015 2/2 period of nine months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Kotwali P.S. Case No. 665 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The provisional bail of the petitioner will be confirmed by the learned court below only on return of the entire loan amount along with interest within the stipulated period, else not. (Dinesh Kumar Singh, J) Anil/- U
