The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 8 litres of liquor was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of his antecedents. No incriminating article has been recovered from his possession or his house. He was not arrested at the spot. He is in custody since 13.1.2021. The application for bail is opposed by learned A.P.P. for the State who submits that the petitioner has large number of cases under the Bihar Prohibition and Excise Act, 2016

Patna High Court CR. MISC. No.48592 of 2021(3) dt.21-03-2022 2/2 pending against him from before.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having been arrested at the spot and having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Warisaliganj P.S. Case no. 198 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Nawada.
