Petitioners apprehend their arrest in connection with Madhepura P. S. case no. 560/2014 registered under sections 414, 467, 469, 471, 420, 120B/34 of the IPC.

A truck laden with wheat was seized by the police officials and thereafter, present case was registered on the ground that seized wheat was stolen property.

Learned counsel for the petitioners drew my attention towards annexure 7 to this petition as well as other documents to show that seized wheat was not stolen property.

Admittedly, petitioner no.1 is truck owner whereas petitioner no.2 is owner of seized wheat.

Considering the aforesaid facts and circumstances as well as

No.4222 of 2015 (2) dt.02-02-2015 submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in Madhepura P. S. case no. 560/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
