The petitioner has preferred this application for grant of regular bail in a case registered under sections 419 and 420 of the Indian Penal Code and section 66 (C) and (D) of the I.T. Act. As per the prosecution case, information was received by the informant about accused persons interpolating the Bank accounts of innocent citizens and of cheating them of their amounts kept in the Bank accounts. A raid was conducted by the informant along with other police personnel and while other accused persons managed to escape, the petitioner was caught and a mobile phone besides other articles as mentioned in the F.I.R. was recovered from his possession. He disclosed the name of four other accused persons who had managed to

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He was caught under some misunderstanding. No incriminating article has been recovered from his possession. He is in custody since 7.7.2021 and chargesheet has been submitted in the case. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation, the petitioner having remained in custody for more than 8 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Kashichak (Shahpur O.P.) P.S. Case no.113 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Nawada.
