An order dated 03.12.2014 passed by learned 5th Additional Sessions Judge, Motihari, East Champaran in Sessions Trial No. 862 of 2013 has been challenged, whereby the Court below has rejected an application filed on behalf of the petitioner under Section 227 of the Code of Criminal Procedure, 1973 (hereinafter referred to as the Code).
I have perused the impugned order and the pleadings on record. From the said order it appears that the Court below on perusal of the materials collected in course of investigation arrived at definite finding that case under various Sections of the Indian Penal Code was made out for the purpose of framing of charge.
I do not find such conclusion to be erroneous requiring this Court's interference.
This application has no merit and is, accordingly, dismissed.
