This contempt application was filed alleging contempt against the District Magistrate, Jehanabad for not taking steps in compliance with the judgment and order passed in CWJC No. 2311 of 2015 whereby he was required to dispose of the statutory appeal to be preferred by the petitioner under the provisions of the Public Distribution System (Control) Order, 2001 within a period of three months from its filing. It was submission of the petitioner that the appeal was filed on 30.5.2015 but remained pending with the District Magistrate for disposal. A show cause has been filed present at Annexure-A enclosing the order of the District Magistrate in Appeal Case No.

Patna High Court MJC No.1222 of 2016 (4) dt.29-06-2016 17 of 2015 and whereby the appeal has been dismissed. In the circumstances, no case for contempt is made out and this contempt application is accordingly disposed of with liberty to the petitioner to question the order of rejection of appeal passed by the District Magistrate enclosed at Annexure-A to the show cause by filing an appropriate application before the appropriate forum, if so advised.
