2. The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioners who are in custody in connection with Nayaram Nagar P.S. Case No. 96 of 2025, lodged on 05.10.2025, under Sections 126(2)/115(2) /351 /352/74/103/3(5) of the Bhartiya Nyay Sanhita, 2023 and under Section 3/4 of the Bihar Dine Act, 1999, pending in the Court of Sri Shaktiman Bharti, learned Judicial Magistrate, 1st Class,
Patna High Court CR. MISC. No.40100 of 2026(3) dt.27-07-2026 2/3 Munger.

As per the prosecution, FIR has been lodged against seven named accused persons including the present petitioners against whom there is allegation that with intention to kill the informant branding her a Witch, all the accused persons armed with arms and sticks came to her house and assaulted her and her husband and her daughter due to which her husband succumbed to the injury and the informant and her daughter sustained injury and went to Sadar Hospital for treatment.
4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel submits that there are general and omnibus allegation against the petitioners. He submits that deceased was a very old person aged about 65 years and was under treatment due to several ailments and injury has been caused due to fall upon the ladder. He submits that charge sheet has been submitted against the petitioner and cognizance has been taken. Counsel submits that the petitioners are in custody since 18.01.2026 having clean antecedent. Counsel further submits that petitioners are ready to fulfill all the conditions whatsoever shall be imposed upon them.
5. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.40100 of 2026(3) dt.27-07-2026 3/3 bail of the petitioners and submits that from the record, it transpires that due to the assaults of the petitioners the husband of the informant died.
6. Considering the nature of allegation, this Court is not inclined to grant bail to the petitioner at present. Hence, the prayer for bail of the petitioner is hereby refused. (Dr. Anshuman, J) Mkr./Anshuman/ U T
