The petitioners, namely, Arbind Kumar Singh and Ranjit Kumar Singh are apprehending their arrest in a case under Sections 341, 323, 504/34 of the Indian Penal Code and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Manoj Ram, the informant, made allegation that oldage-pension was being given to others whereas the informant was not given the same. On protest, the petitioner no. 1, Arbind Kumar Singh, who is the Mukhiya of the concerned Gram Panchayat, abused the informant and assaulted him. The other accused persons also abused and assaulted the informant. Learned counsel for the petitioners submits that the allegation is false. Prior to lodging of this case, the petitioner no. 1
Patna High Court Cr.Misc. No.2475 of 2015 (2) dt.20-01-2015 2/2 lodged a case against the informant which was registered as Hayaghat P.S. Case No. 55 of 2014 under Section 307 and other sections of the Indian Penal Code and Section 25(1-b)a, 26 of the Arms Act. The informant had come with arms and tried to assault Arbind Kumar Singh, petitioner no. 1. The informant pointed out pistol at him but the villagers caught him and snatched the pistol from his possession. The informant was handed over to the police. After the above incident, the informant lodged the present case against the petitioners.
Having considered the facts that the informant himself was made an accused in a case instituted prior to the present occurrence and other accused persons in the present case have already been enlarged on anticipatory bail, let the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in Hayaghat P.S. Case No. 56 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. Dilip/- (Prabhat Kumar Jha, J) U T
