The petitioners, namely, Panchan Singh @ Pancham Singh, Mahesh Singh and Ravindra Singh are apprehending their arrest in a case under Sections 341, 323, 379, 384 of the Indian Penal Code.
The complainant made allegations against the petitioner that they assaulted her and also took away Rs. 18,000/- from her possession. She further alleged that the accused persons took her thumb impression on a plain paper.
Learned counsel for the petitioners submits that the petitioners and the complainant belonged to the same family and
Patna High Court Cr.Misc. No.2478 of 2015 (2) dt.20-01-2015 2/2 on account of land dispute, the present case has been filed making absolutely false allegations against the petitioners.
The complainant and her witnesses have also stated that the petitioners are co-sharers and there is a land dispute amongst them. Having considered the fact that on account of land dispute, the present complaint case has been filed, let the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Rasmi, Judicial Magistrate 1st Class, Muzaffarpur in Complaint Case No. 1470/2013 (Tr. No. 4174/2014), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
