JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 14-02-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Manjhagarh P.S. Case No. 128 of 2021 instituted for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Taking into consideration the nature of allegation that the petitioner was not present at the site, neither the recovery was made nor the vehicle is in his name, I find that prima facie case under Section 30(a) is not made out, I am inclined to allow the petitioner on bail, in the event of arrest he shall be released
