The petitioner apprehends his arrest in Hasanpur P.S. Case No. 80 of 2014, registered for the offences punishable under Section 366A and other Sections of the Indian Penal Code. The informant named the petitioner and other accused persons and alleged that they kidnapped his minor daughter Damani Kumari. The victim was recovered and she made her statement under Section 164 of the Cr.P.C. and she disclosed that Shravan Paswan caught her hand and Rahul put clothes on her mouth, thereafter she became unconscious. Shravan Paswan took her to Goa, from there the victim and Shravan Paswan was apprehended. The victim did not disclose the name of the petitioner as her kidnapper.

Patna High Court Cr.Misc. No.3159 of 2015 (2) dt.22-01-2015 Considering the facts aforesaid and the fact that the victim herself did not name the petitioner in her statement made under Section 164 of the Cr.P.C. as her kidnapper, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri K. Kumar, the learned Judicial Magistrate, Ist Class, Rosera, Samastipur in connection with Hasanpur P.S. Case No. 80 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
