The petitioner seeks bail in anticipation of his arrest in connection with Aurangabad Muffasil P.S. Case No. 98 of 2020, dated 01.03.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. A sumo-victa vehicle was intercepted and

Patna High Court CR. MISC. No.36027 of 2020(2) dt.05-04-2021 2/3 seized from where there was recovery of approximately 240 litres of liquor. The driver of the vehicle was arrested. He is said to have disclosed that the consignment given to him for transportation by one Rajiv Kumar. The name of the petitioner has transpired in this case on the presumption that the vehicle in question belongs to him.

The learned counsel for the petitioner has submitted that he had sold the vehicle to one Santan Kumar for consideration, who was arrested during the course of raid.

Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-VII-Cum-Special Judge, Excise, Aurangabad in connection with Aurangabad Muffasil
