The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 324 and 307/34 of the Indian Penal Code.

It is alleged that on 26.07.2015 the petitioner Bablu Kumar caught hold of the informant when coaccused Kunal Kumar assaulted with sword on his neck but his left ear got chopped.

It is submitted by learned counsel for the petitioner that the accusation of assault is not against the petitioner. The petitioner is accused in one other case but he is on bail. Statement to that effect has not been made in paragraph 3 of the petition.

Patna High Court Cr.Misc. No.23911 of 2016 (2) dt.30-05-2016 2/2 Considering the nature of accusation, it is a case for consideration of prayer for regular bail by the learned court below keeping in view of the fact that for the occurrence of 26.07.2015 at 10.30 A.M. the FIR was registered on 26.07.2015 at 4.50 P.M., if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Warisaliganj P.S. Case No. 212 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Nawada. With the aforesaid observation, this application is disposed of.
