2. The petitioner apprehends his arrest in connection with Puraini P.S. Case No. 234 of 2025 registered for the offence under Sections 103(1), 3(5) of B.N.S.

3. As per the prosecution case, deceased was suspected to be a thief who was brutally assaulted by general public including the petitioner.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. Petitioner has clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts, this is not a fit

Patna High Court CR. MISC. No.37669 of 2026(2) dt.30-06-2026 2/2 case for grant of anticipatory bail.

7. Accordingly, this application stands dismissed.

8. The petitioner is directed to surrender within two weeks and pray for regular bail in the court below and the court below will consider the fact that similarly situated co-accused persons having similar allegations have been granted bail by this Court.
