The petitioner who is in custody since 18.01.2019 has filed the instant application for grant of bail in connection with Barhat P.S. Case as No. 5 of 2018 registered for the offence punishable under sections 395 and 397 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that the FIR was registered under sections 395 and 397 of the Indian Penal Code against 7-8 unknown persons. The name of the petitioner transpired on confession of co-accused Vijay Pandit. There is no recovery of any incriminating article from the possession of the petitioner. He has not been put on T.I. Parade, the investigation has concluded and he is in custody since 18.01.2019.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner has not been put on T.I. Parade, investigation has concluded as also he is in custody since 18.01.2019, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Jamui in connection with Barhat P.S. Case No. 05 of 2018.
