The petitioner, who is in custody since 03.08.2020, seeks bail in connection with Barauni (Garhara) P.S. Case No. 278 of 2020 dated 02.08.2020 instituted for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act.
From the possession of the petitioner three country made pistols, one empty magazine and six live cartridges have been recovered. The petitioner appears to have disclosed the source of such firearm weapon and ammunition.
It has been submitted on behalf of the
Patna High Court CR. MISC. No.35733 of 2020(2) dt.19-01-2021 2/2 petitioner that he is innocent and has been made victim of circumstances. In fact, he is a student of Intermediate with no criminal background. The petitioner asserts that he has got no concern with the accused persons of Garhara P.S. Case No. 275 of 2020 which finds reference in the FIR.
Regard being had to the period of custody of the petitioner, nature of accusation and his being a person of clean antecedent, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Barauni (Garhara) P.S. Case No. 278 of 2020.
