The petitioner who is in custody since 04.01.2019 has filed the instant application for grant of bail in connection with Sahebpur Kamal P.S. Case as No. 329 of 2018 registered for the offence punishable under sections 25(1-B)a, 25(1-AA), 26 and 35 of the Arms Act.

The allegation in the FIR is that on a raid being conducted on the house of the petitioner, the petitioner as also his brother managed to escape. One country made pistol and cartridges as mentioned in the FIR and seizure list, were recovered.

It is submitted by learned counsel for the petitioner that the case of the petitioner stands on similar footing to that of

Patna High Court CR. MISC. No.37830 of 2019(3) dt.11-09-2019 2/2 co-accused, his brother Amarjeet Yadav who has been enlarged on bail by order dated 17.05.2019 passed in Cr. Misc. No. 32712 of 2019 and that the petitioner surrendered on 04.01.2019 and is in custody since then.

The application for bail has been opposed by the learned APP for the State.

Having heard learned counsel for the parties and taking into consideration that similarly situated co-accused has been enlarged on bail and that the petitioner is in custody since last eight months, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V-cum-Sub Judge III, Begusarai in connection with Sahebpur Kamal P.S. Case as No. 329 of 2018.
