ANJANA MISHRA ORAL ORDER 11-03-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Gaya Civil Line P.S. Case No.253 of 2014 for allegedly having committed the offences under Sections 147, 149, 341, 323, 307 and 504 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the F.I.R. in the present case has been lodged at the instance of tempo Driver, who was carrying the children back from the school. Learned counsel for the petitioner submits that, in fact, the present case is one of negligent driving by the Driver of auto vehicle, who was carrying children back from the school and only in order to save his own skin on account of rash and

Patna High Court Cr.Misc. No.41161 of 2014 (3) dt.11-03-2015 2/2 negligent driving, he has implicated the petitioner and others who had been affected by his own rash and negligent driving. Considering the aforementioned submissions and also the injury report, as indicated in Annexure 2 to this application, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Gaya Civil Line P.S. Case No.253 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
