At the outset during the course of argument it is submitted by learned counsel Mr. Vijay Kr Singh No. 1 appearing for the petitioner that the petitioner preferred the regular bail prayer before the court below which was rejected vide order passed on 16.06.2022 giving a liberty to the petitioner to renew his bail prayer after six months if his trial is not concluded and by mistake of fact the petitioner without availing the said liberty filed the instant miscellaneous petition directly to this Court and now he wants to withdraw this Cr. Misc. petition as he firstly wants to avail the said liberty given by the court below.

In view of above mentioned prayer the instant Cr.

Patna High Court CR. MISC. No.39541 of 2022(2) dt.21-11-2022 2/2 Misc. petition stands dismissed as withdrawn and the court below is directed to decide the petitioner's regular bail prayer if the same is preferred in the next three weeks without being prejudiced of this order but keeping in view the liberty given by the court below to him.
