Mr.Gauri Shankar Gupta ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 20-06-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bhagwanganj P.S. Case No. 107 of 2018, instituted for the offence under Section(s) 302/201 and 34 of the Indian Penal Code.

Counsel for the petitioner submits that mere suspicion has been raised by the informant against the petitioner. It is alleged in the written report that husband of the informant namely Duryodhan Ram and her cousin Devar Shambhu Ram were both constructing house of co-villager on contract basis. During course of construction of house, dispute arose between them for money. It is further alleged that on 16.7.2018, they both began to fight with each other. There was firing from both sides, In course of firing, Shambhu Ram died. Thereafter, Lilouti Devi, wife of Shambhu Ram instituted First Information Report against informant and her husband namely Duryodhan Ram (since deceased). The

On 19.7.2018, husband of the informant left for the house of elder daughter Nitu Devi and, thereafter, the informant got information on 20.7.2018 that dead body of her husband was hanging on a tree near Suryamandir in front of Punpun river. The informant has alleged that petitioner in conspiracy with other accused has committed murder of her husband.

In this manner, mere suspicion has been raised against the petitioner. Petitioner is lady. She is in custody since 7.2.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Masaurhi, in connection with Bhagwanganj P.S. Case No. 107 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
